That's an interesting question that is brought up by the documentary we will be watching parts of this week. Basically, it depends on whether the action is also illegal (gov't passed a law prohibiting the action)

any court case has two sides: the one suing/prosecuting their case and the side defending. Each side can have multiple parties involved. But it's not always about "getting what one wants." It's about the court interpreting what the law means and if it is constitutional or not.

Clarify this a bit. Plessy was 1/8 African American but was very light skinned. Plessy was selected in part because he was so light skinned. How would trains know if people were actually non-white? So how could people be treated equally?

Judge Ferguson basically is stating that since Louisiana made laws only for Louisiana and not another state it was constitutional. If Louisiana had tried to make the law apply to another state (like Texas or Missouri for example) then the law would be unconstitutional because states can only make laws for themselves.

We were just having this conversation in our home last night. C19 is really going to further push the labor divide towards further mechanization and remote working. So where does that leave the labor pool? And it also leaves the question of how much do we value relationships as a fundamental part of our work experiences? Does it need to have valuation on a quantifiable economic scale in order for it to be given due deference for labor and management interactions?

systematic oppression as a result

This directly results in systematic oppression of those that do not hold power, whether it be based upon gender, race, socioeconomic status, etc. The "Law and Order" crowd exists purely for the sake of obedience and does not value those that are able to question and challenge the system built to maintain the power structures in existence. This roots again in the idea of the individual as many use individualistic reasoning to validate their own actions (nobody helped me, I follow the rules, etc.)

at odds with American ideals

This is also at odds with the truly American belief in American exceptionalism that rests its foundation upon the power of rugged individualism. Society is often, in practice, not valued most highly within the American culture. This is evident by the difficulty with which we are able to subsume our own individualistic desires in order to advance socially.

This assumes a premise that this is the purpose of education. There are many that would disagree and see education as utilitarian. Thusly, education that goes beyond the range of the traditional becomes labeled as "indoctrination" and is viewed as a dangerous encroachment upon the realm of the parent.

I think this would be good to utilize within discussions whether they be formal structured ones like Socratic Seminars or informal discussions. The online format pushes inclusion while allowing "quiet" students voice in a different form. The added layer of technology allows for students to have a filter between themselves and their audience. This is especially important for kids who suffer from performance anxieties.
